Exclusion Of Liability & Assumption of Risk

The use of event premises and facilities and participation in activities at the event areas involves various risks, dangers and hazards.

It is a condition of your use of the premises and facilities and your participation in these activities that you assume all risk of personal injury, death or property loss resulting from any cause whatsoever, including negligence, breach of contract, or breach of any duty of care on the part of the event operator.

Your legal responsibility as a user of the event premises and facilities or participant in activities at the event area is explained in the following notice, which you will see posted at the event premises.

VISITING EVENT AREAS

The risks may include, among others:

  • physical or emotional injuries including but not limited to:
    • slips and falls;
    • scrapes; 
    • cuts;
    • bruises;
    • muscle strain; 
    • twisted or sprained ankles, knees, shoulders, or wrists; 
    • burns;
    • dirt or other materials in eye;
    • impacts with other people;
    • concussions; 
    • broken bones;
    • disorientation; 
    • nausea;
    • food poisoning;
    • impaired balance;
    • entanglement;
    • light-headedness; 
    • fatigue; 
    • motion sickness;
    • emotional distress;
    • paralysis;
    • seizures; 
    • loss of awareness; 
    • eye strain; 
    • dizziness;
    • other bodily injuries;
  • environmental hazards including but not limited to:
    • trip hazards and uneven footing, that may contribute to trips, slips and falls or could delay medical assistance or evacuation from any event site;
    • crowd-related hazards, including pushing, collisions, trampling, or panic responses;
    • movement of vehicles or equipment on or near the event premises, which may result in collisions or impact injuries;
    • cold weather that may result in discomfort, and may lead to hypothermia;
    • hot weather that may result in discomfort, and may lead to heat stroke;
    • biting insects, including mosquitoes and ticks;
    • injuries resulting from contact with wild or domestic animals, including bites, impacts, scratches, or infections;
    • injuries resulting from trees, including branches or trees falling, causing laceration, impact injuries, or death;
    • water hazards, which may lead to slipping, falls, or drowning risks;
    • impacts with the wall, ground or other structures and equipment;
    • breakage, malfunction or failure of equipment used in the offered activities including but not limited to set pieces, axes, targets, or other game pieces;
    • infectious disease contracted through viruses, bacteria, parasites, and fungi which may be transmitted through direct or indirect contact;
    • open flame, including campfire, that may contribute to burns, smoke inhalation, burning eyes, runny nose, and illnesses, such as bronchitis or other related injury;
    • sharp objects, including axes, spears, swords, and knives, that may cause slashing or piercing wounds;
    • lightning strikes, severe weather events, falling trees or branches, and wildlife encounters, each of which may result in one or more of the injuries listed above, including death;
  • loss, theft or damage to personal belongings including, but not limited to tents, RVs, trailers, food, clothing, equipment and gear, motor vehicles and bicycles;
  • and negligence of other persons including the event host, the property owner, or any employee or representative of the event.
